General terms

The Pefa subscription offers a user entitlement to the Pefa auction system available at www.pefa.com. An agreement with a user only arises after acceptance by Pefa of a completed application.

A buyers subscription allows access to the clock auction (Pefa Auction Clock) and places the user in a position whereby it becomes technically possible for them create transactions by means of the clock auction site. Next to that it also provides the user with access to the secured area of the Pefa website. Additionally, this subscription can be extended with access a data link to receive all transaction data in real time.

A fishermen subscription (Pefa Data) allows access to the secured area of the Pefa website. Additionally, this subscription can be extended with access to the clock auction and places the user in a position whereby it becomes technically possible for them see the auction sales, but not to create transactions.

A paid subscription to Pefa eLog allows the fishermen to report their fishing trips to their EU government in accordance with EC1224/2009 and allows to report fishing trip information to their Pefa-connected fish auction. A free subscription offers the possibility to report fishing trip information to Pefa-connected fish auctions.

All subscriptions are valid for a period of one year and will be automatically renewed for a period of one year, unless a subscription is ended by one of the parties, taking due account of the period of notice required, this being a period of three months.

The user is to ensure that their computer system meets the minimum requirements as are stated at www.pefa.com.

All rates stated are exclusive of VAT and are subject to price changes. Pefa retains the right to alter the rates on a unilateral basis. The current rates are stated at the actual version of the subscription form. The current rates are also available at the service pages on this website. An annual indexation of the rates is carried out in line with the consumer price index. All Pefa invoices have payment terms of 15 days.

If the user fails to pay the amounts due or to pay the amounts due in a timely manner, statutory commercial interest shall be payable by the user on the outstanding amount without a demand or notice of default being required. In such a situation Pefa retains the right to suspend access to the system without prior notification.

Pefa is not liable for any damage that is a consequence of the use of their system. Pefa expressly states that they accept no liability for the accuracy of the information available on their systems. The user indemnifies Pefa against any damage that may possibly arise through the use of the system.

The user declares that they are aware of and in agreement as to the validity of all terms and conditions that may be applicable with respect to the use of the Pefa systems and any purchases made through the auction sites connected to the system.

Pefa and Pefa.com are trade names of Pefa B.V., which is registered at the chamber of commerce in the Netherlands under number: 27310765.

With regard to all legal relationships with respect to Pefa, Dutch law applies exclusively and the District Court of The Hague is duly authorized to act in all matters of dispute.
